Hi everyone, I need good idea about how to solve this problem. The problem is, in june 23rd there was a car accident but police was not involved. The fault is still unknown. I was going in the middle lane (not the center lane , i mean middle of three lane in oneway) and someone passed me (overtake) from left lane and his right side looking mirror broken. There was not even single scratches in my car. He claimed my insurance but there was something wrong in my insurance. The problem with insurance is that I was paying by every 23rd of the month. The coverage was until 24rth of the month. In March month I paid the money 2 hrs late and they reinstate my insurance. Next coverage was until 24th of April. Still the insurance was continue until 24th. But last May month was 31 days long and they started my coverage until 23rd of the June. They started counting days. In the last 14 month they never counted the days. I mean every month the coverage was until 24rth. So I had to pay before 23rd I mean by end of 22nd. I didn't notice that day. I though I can pay by the end of 23rd. But the accident happened 6 PM of 23rd according to insurance company my insurance was end before 23rd because I didn't pay by 22nd. And I paid at 7 PM of that day (23rd). They say they can't cover the insurance. The guy went into the court and claimed around $1000 for a single looking glass broken. I have to go court this Wednesday. Can I ask the question to the judge to decide whose fault was that? If that was my fault, Can I ask why $1000 for a single mirror broken? If I have to pay $1000, I can't pay now then What can I do? Do the insurance should pay the money? Please I need suggestion and Idea.

Well I am not an expert but I will tell you what I know. First of all Insurance Company,Credit Card Company etc will always try to show your fault so you should raise your voice against the insurance. You know the date the insurance company are liable upto. Regarding Court it is just a normal room. No need to panic at all. Ask whatever you need to and only answer what is asked.And yes even if you are liable to pay, tell them you don't have all the money, or you can't pay all them. Or I can buy a mirror for 50/60 dollars and have them fixed. Remember you have to speak! Chill out!

The insurance company is liable for the loss (as long as you have the Collision coverage) regardless of whether or not you paid your monthly installment. The indurance company will not be liable only if they had sent you a cancellation notice for your policy (which does not happen until certain number of days without payment). As long as the cancellation notice is not sent, you should still be covered even if you haven't paid the installment for the month.

Appreciated your suggestion. I am wondering even that whose fault was that. because nobody was involved to decide and police was not involved. If can't pay the amount that the court decides then what happens next?

If you are true in saying that the guy broke his rear view mirror while overtaking you, then it may not be your fault. so go to the court and describe the situation and ask court to determine whose fault is this.
