I have some immigrations and rentry questions and hope someone can help me out.
I graduated from USA and now I am currently in Nepal. I became out of status in USA for almost like 2 years. Now I want to return back to USA for my further studies in Masters. Is it possible to get visa to go back , will they check my past status at immigration? Your suggestions and informations are highly appreciated. If I cant go back to USA for my further education, please suggest me to go to Canada, Australia or UK.

Thanking you

Dear friend:
If you were out of status about 2 years, there is very slim chance that you will get visa for masters. At least you have to wait 10 years to get your history to be old enough.
Yes, when you filll the application for visa, you must give your information that you were in USA from this date to this. If you do not do, that is negative factor. They do check all the record before they come to you for the interview. Yes, they do keep the record of all the students here and there.

One of my cousin over stayed about a year after his Graduation. He went to nepal and after 6 months, he applied for canada.
Canadian embassy reviewed his application of visa for 45 days and finally approved it. Now he is in Canada, BC. He is doing fine and keeps telling me that he has almost the same kind of study and life style over there.

Canadian Embassy checks all your US background history, if you do not have any negative record, you should be approved for the visa if completed the required documents. US School Graduate candiate is always in their OK list.
I am not discouraging you to apply for usa again, just giving an idea. You may try before or after you try for canada.

I have a similar question....I was studying at a community college before, and I got out of status for having less than full credit ( which by the way wasnt even my mistake, some pre-requisite not mentioned in the system anywhere got me less than 12 credits) and so had to re-instate in status. Since it wasnt even my fault, they reinstated my status without any problem.

But I heard that if you have re-instated your status once, you wont be able to get a visa back to US. I was plannin to go back to nepal this summer. Does anybody know how the system works for re-instated students??

Dear Friend, Sajha User

Thanks for your information and suggestion. Glad to hear from you. I really appreciated your information. If you could send me more details about it, that will be great. As I wrote you earlier, I graduated from US and I am in Nepal now. I want to go to US for my further studies in Masters. Being out of stauts for a while, if that is the case I want to try for Canada. Please send me the University's name where your brother is attending and visa procedures for Canada . My email add is nicki_boston@yahoo.com

dc_virus, as my understadning, if you were here and was out of status for a semester for taking less class, it would not be problem for you to get visa. Just do not mention them when you apply for the US visa unless you have to. It was not your intention to be out of status and break the law and they know about it. Good luck! Good luck to aroma too!

DC_virus don't even need to take risk to apply visa at kathmandu because if you're studying here, you already have visa n' i assume it to be multiple entry visa. So in that case, you don't need to worry anything. If you're about to complete, you can be in OPT. But if you're not going to have any visa; you can get admission and simply extend visa here through inter'l office at school, and can travel with the same privilege with multiple entry visa. You can avoid completely going to embassy at ktm.
