Hi,
I came to the States in the Spring of 2009. So its already more then 1 year that i am here. I am in F1 status.
I know that there is a 1 year criteria to apply for it. Can anyone please help me answer some of my questions? It will be a great help for me..
1. Can i go to Nepal and come back this August and apply for it? 2. Do i need to change my status when/after i apply for it? Since i am in F1 status now, will i be able to remain in same status and continue my study after i apply for it? 3. What if my application gets rejected? Will i be deported or i will be left back in F1 status?
It will be very help ful for me if anybody answers these 3 questions.

How bout you maintain your F1 status? Just go to some cheap college and get a c in all courses. For 5 years you can make all the money you want will all the travel facilities. Asylum isn't as easy as it sounds. How hard can going to college 2 days a week be?Thousands of students are doing it. You should too.

Here is what i know -After one year, if you file asylum make sure you have decent reason. Like the things was well till last one year, but changed now. -maintain your f1 status untill your asylum interview is done. If they reject you, then there is a phase ( forgot the name of phase) where they will check your history. If you have maintained your status, you dont have to worry and you can continue your status. However, if you havent maintained your status, your will be in deep trouble.

1) If your circumstances back home has been changed after you got here or over the limit of 1 year, wouldn't matter and you can still apply for that with absolute reason. 2) After you are granted asylum, you have to do some paper work which automatically adjust your status by the officials. 3) If your case is denied, you can always pursue or continue your study on your f1 status. Nothing would happen in your status and things like that. You will be automatically send back to your previous status unless your illegal which is different case for you. Later, you'll get a letter from official saying "Intend to Denied" in this case it's up to you either go for your study or forward your case to COURT within certain date. But in order to go for Court you have to be illegal by not going school after that. But again be clear, it's all you choice and decision what to do, i don't get any credit or blame for it. please read this, it may help you: 1 year rule to file asylum does one year rule apply to only unauthorized stay? the time you stayed in the USA on a valid visa don't count. so a student files an asylum after expiring his I20 is okay even it is after 5 years? please read the following:

You may not be eligible for asylum if you yourself have participated in persecution of others, or if you've "firmly resettled" in a country other than your home country (for example, by obtaining permanent residency in a country other than your home country or the United States). And fear of poverty or random violence isn't of itself enough to qualify you for asylum.
There is no limit on how many people may be granted political asylum each year in the United States.

but here are other few things you need to consider in your situation: if your asylum gets denied you will come back to f1 status if you have been maintaining it. but f1 is not a dual intenet visa. meaning you can not intenet to stay permanently in f1, so uscis does not look at it in favorable way if you get denied and come back to f1. specially if you want to travel using your i-20 or if you want to do i485, green card based on other catagories. but again, i am just thnking critically so please don't blame me. most asylum are approved in the court. if you come back to f1, u won't have a chance to go to court.

If someone been through or have thought about it, what would make you case very strong and what kind of story would give yourself a maximum chance of getting approved other then Maoists. Help me please..
