I have been working on OPT for the last 1 year, I just found out that you don't have to pay social security and medicare while you are on OPT. I have been paying that for the past 1 year. I notified my payroll about that, they are going to stop deducting in the future but they have asked me to file myself to get the ones i have paid in the past. Does anyone know what all you need to do????? Any kind of suggestion and help would be appreciated....Thanks

when i was doing internship under CPT, the company people accidentally deducted social sec and medicare tax. i notified the human resource dept and they took care of it. they should know the process better than us trying to figure out what to do. i'd suggest contacting them again.

Dude... I had the similar problem....you need to submit following (http://www.istaxes.com/taxes/form-8316.html) - a completed Form 843
- a completed 2008 Form 8316
- a copy of your W-2
- a copy of the visa page of your passport
- a copy of Form I-94
- a copy of your work authorization (copy of your EAD authorizing OPT or Economic Hardship)
- a copy of front and back of your Form I-20 or DS-2019 authorizing CPT
- a
written statement that you unsuccessfully requested a refund of these taxes from your employer. (This can be the statement you obtained from your employer, or your own statement that you were denied refund of these taxes by your employer and were unable to obtain a statement from them.)
