I got Receipt Notice Dates of Nov 6, 06 for both the I-140 & I-485. But in the USCIS website, the latest dates for these are Dec 26, 06 and Mar 03, 07. I called their number but all I got was an automated message giving me the latest update on my applications saying they are pending. The date has already exceeded by more than 30 days. Is this the usual thing that happens with USCIS?

In order to get Green Card, your labor should have been approved and I-140 should be cleared as well. How come they process I-485 without I-140. There is currently 95000 I-140 backlog.

Infopass meaning you go to the immigration officer in person and ask about your case. They have 800 customer service number as well. But infopass works better is what AX is trying to say.

So, KINA KINA, your theory makes no sense. If your labor is cleared, try filing GC soon from July as the visa date will be current, otherwise you may hit with retro soon.

Due to backlog I think yours is pending. You may want to upgrade it to Premium Processing, which is $1000 extra. You will get approval in 15 calendar days. You can try INFOPASS as well, but check the current processing dates on USCIS website.

You can try it, chances are they simply will let you walk away stating your date is not current yet.

My labor has just been filed few weeks back. I am going through EB2. Do I add my wife during 140 or 485 process? We got married in Nepal one year ago and we don't have marriage certificate since as you know it's civil marriage. We did not have time to go court in Nepal.

Now I want to get marriage certificate but I heard from someone both myself & wife need to go Nepal and stay like 19 days or something to get marriage certificate. Anyone have been through this problem? What is best way to get marriage certificate without going to Nepal? Can I use just marriage photos as evidence?

Thanks to everyone who provided answers to my questions in my previous posting.

Fees for the whole GC process is $6500 and $1000 for your family each GC processing. ($4000 for PERM LCA stage, $1500 for Form 1-140 Stage and $1000 for 485 (and EAD and AP) stage.

EB2 Form 1-140 (regular processing) $195, Premium ($1195)
Forms 485, EAD and AP = ($395+180+170) / each person

The USCIS fees are chaging significantly effective July 30. Check the uscis website.

Where is this announcement referring to the temporary suspension of all Premium Processing for I-140s? I just checked and didn't come across any such announcement in the official USCIS website.

They are always slow to update in their website. Immigration Lawyer Association update faster than USCIS. Here is the details of update.

Saan Dai

----------------------------------------------------------------------------------------------------
June 27, 2007

USCIS Announces Temporary Suspension of Premium Processing Service for
Form I-140, Immigrant Petition for Alien Worker
WASHINGTON – Effective July 2, 2007, USCIS is announcing the temporary suspension of Premium
Processing Service for Form I-140, Immigrant Petition for Alien Worker, in accordance with 8 CFR
103.2(f)(2). USCIS anticipates a substantial increase in the number of petitioning employers that will file
Form I-140 petitions requesting Premium Processing Service as of July 2, 2007. This is due to pent up
demand for preference visa categories for which visas will become available according to the Department
of State July 2007 Visa Bulletin. The volume of Form I-140 petitions filed that request Premium Process
Service is expected to exceed USCIS’ capacity to provide the Premium Process Service according to the
Premium Process Service program guidelines.
Premium Processing Service guarantees that within 15 calendar days of receipt of a petition, USCIS will
issue either an approval notice, a notice of intent to deny, a request for evidence or open an investigation
for fraud or misrepresentation.
This suspension will last for 30 days beginning on July 2, 2007 and ending on August 1, 2007. During this
timeframe, USCIS will determine whether it is able to process these cases within 15 calendar days of
receipt. If so, Premium Processing Service will once again be made available for Form I-140 petitions.
