Is there any consequences if I file TPS (with EAD) when my h1b is pending. I have very less time since I am on cap gap extension, and worst case if my h1b is denied then I will have more less time.

RFE doesnt mean shit. Be positive. I would take the $515 hit and file for TPS just in-case though.

BTW , CPT ? Pleas don't tell me you were from Vast*** Inc as well. I heard a bunch of people got RFE from there.

fdpower, I am on cap-gap extension. It is not Vast*** Inc, it is tiny start up company. I am positive of approval, however I just want to be on safe side if worst case happens. I want to make sure if filing TPS (with EAD) would cause some negative consequences on my pending h1b.

Malai ta kei ni hudaina jast lagcha yar. TPS is TPS and you are qualified for it and since it is not a status(technically) , as long as you keep the original status alive I think you should be fine.

Also timro company ma multiple people lai H1b file haneko thio ? or was it just you ?
Mero auta sathiko got rejected because the company filed for another guy with similar position as well with similar job description however the other guy only had bachelors degree and my friend had a masters. Reason: Overqualified for the position satisfiable only by a Bachelors degree. Plain stupid.

Mero company ma malai matra H1b file gareko cha. RFE pani related to speciality occupation mai generate cha. Aru document haru pani maageko cha.

I think I will go for TPS as well, cap-gap ma deny bhayo bhane 2 months ko matra grace period huncha, tps lai 3 mahina lagcha feri. Baru h1b approve bhayo bhane TPS use nagarda pani bhayo.

TPS chai 2 mahinama nai huncha most of the cases ma. I think I was the first want to get the TPS approved.

Acid, if I were you, I will go for premium processing for H1-b. It cost around $1,200 (i guess). Premium processing takes only 1- 2 weeks after submitting all RFE docs.
