Recently made changes to health benefits by removing spousal coverage completely. HR is requesting coverage elections for my spouse. Are companies legally allowed to ask for coverage information if spouse accepts their own employer provided benefits package? I need to know what right do I have so I don't need to disclose spouse personal benefits information provided through her place of employment.

I am no expert but my understanding (according to my experience):
- One can not have his/her spouse on his/her plan if his/her spouse is offered coverage though his/her employer.
- I had my wife on my plan when she was unemployed. But when I applied to remove my wife from my plan (after she got a job), HR folks asked me to sign a paper stating reason. I don't remember disclosing her job details though.
- You can always change the coverage the way you like on qualified events (change of employment status of you or your spouse and open enrollment period).

This obamacare has been failing since day 1 and is really messed up bill in my opinion. It is basically saying healthy people, middle class people should pay all the bill for low income and sick people. I am all for repealing this messed up obamacare.
