Hi Labor certification was filed on June 19th and the status says still in Process. The time period has been more than 2 months. Lawyer told that the LC is taking 3-4 months to clear at this time. Has anybody experiencing same situation?? It is for VA.

Prem Nepali, Yes Spouse can not work legally. Another disadvantage is you have to renew in 3 years and you have to leave country for at least one year after six years. Seems like nobody in nobody has similar experience in LC filing at this time!!

Last year my labor (PERM) took 10 months without any reason and without any audit. So, we can never say how DOL process the case. However, I have seen my friend's labor getting approved in few days.

My Labor was filed electronically on June 21, 2007 and got approved on July 23, 2007. It was filed under EB2.

Moksh, Do we need experience letter from past employers for EB2 if I have masters degree? I am stuck here,because I am waiting from past employers in Nepal to send me the letters.Can I file labor without those letter?Anyway past employments are not relevant to the job I am doing now. Thanks

Where Does the LC filing go? Each state has their own? Does the LC filing process timings differs from state to state?? It has been 2 1/2 months and status still says - In Process.

Maverick, you don't really apply for GC process. Your lawyer does pretty much everything. All you need to do is follow instructions from your lawyer, fill out the forms, submit photo copies of documents like, passport, birth certificates, marriage certificates, work exp letters, diploma, transcript etc. If your lawyer is lazy then your lawyer will send all the forms to you by email in Word or PDF format and ask you to fill it out and mail it back. GC process is basically three step. Labor Certification, I-140 and I-485. Labor Process: Your lawyer will send out a form. Fill it out and provide copies of all documents requested. The lawyer will place a Job Order with the DOL for a minimum of 30 days, and the employer has to use the following 30 days to conduct recruitment. Normally, it takes about 2-3 months to prepare a case ready to be filed. Once all this is done, Labor is filed electronically with DOL. Mine was filed under EB2 and my labor got approved within 1 month. I-140 and I-485: Mine was filed concurrently (meaning together) under EB2. I believe for EB3 you first file I-140 and after it gets approved, file I-485. Somebody please correct if this is wrong info. Also check USCIS website on a regular basis. USCIS changes rules of the game often. For 1-140 and I-485, my lawyer sent me these forms to fill out. G-28 G-325A - Biographic Information I-131 - Application for Travel Document (This is optional....if you goto Nepal and have this document approved, then you don't need to goto US Embassy for visa) I-765 - EAD (This is optional...this is a work permit) I-485 - Application to register permanent residence. Lawyers will send you instruction sheets and forms. If you are in doubt, ask your lawyer after all he/she is not doing it for free. Either you or your company is paying for his services.

Seems like everybody's labor is approved in 30-45 days. I am wondering why my case is taking so ling time. It has been 2 1/2 months.

My employer has log in id and password. They check and let me know the status. It is still in Process today. It will be 3 months by next week.
