Appeal for Mass Lawsuit Against Past ANA Officers

 

Dear ANA members, volunteers and friends,

It has just come to know that ANA is not in existence  since 2002. A letter from Office of the Attorney General for the District of Columbia states: “The records of the District of Columbia’s Corporations Division show that the corporate registration of the “Association of Nepalis in the Americas” was revoked on September 9, 2002 for failure to file a two-year report due in 2002.”  The letter also states that  “ANA shall be deemed to have been dissolved and shall cease to carry on its business pay its obligations, and distribute its remaining assets.” 

 

The past ANA Officers hid this fact from general ANA members and Nepali communities and kept on doing illegal activities in the name of ANA. The past ANA Officers misused us, misused our resources, our time and efforts for the activities of ANA which were illegal. Therefore, if you are (were) members and/or volunteers of ANA since 2002, we are asking you to come forward, help us drag those responsible in the court of law for their illegal actives in the name of non-profit social organization. Following are the suggested points to be presented in the Office of the Attorney General for the District of Columbia states:

 

1.     1] We seek the DA’s office to investigate all assets of organization since 1983 (included NECC assets) and investigate the responsible past officers for failure to report necessary reporting to the government.

 

2.      2] We seek investigation by DA why the officers failed to keep financial, membership and meeting records of the organization in the past.

 

 

3.      3] We seek full-fledged investigation by DA on all activities and officers of ANA, NECC, ANA scholarship fund and anything related to ANA since 1983 till 2009.

Dear ANA Members, 

The purpose of this is because there is a lot of information that needs to be gathered and presented to the court.  A lawsuit takes a year to two years to occur.  Please select one or two people to serve as point person for all member inquires or questions. That person can gather the questions and have them presented on the day of the conference call to all members.  This will assist us because we can dedicate the time to working on the case and answering all questions at one time versus having to stop and answer questions sporadically.  Thank you.

अमेरिका, अगष्ट ७ ( एनयमक्याफे) एसोसिएसन अफ नेप्लीज इन अमेरिकाज (Association of Nepalis in the Americas) कानुनी रुपमा अहिले अस्तित्वमा नरहेको बुझिएको छ l सन् १९८३ मा अमेरिकाको डिसीमा दर्ता भएको ‘एएनए’ का नामले चिनिने उत्तर अमेरिकामा बसोवास गर्ने नेपालीहरुको साझा संस्थाको रजिस्ट्रेसन सन् २००२ को सेप्टेम्वर ९ तारिखका दिन खारेजी भएको देखिन्छ l ‘एएनए’ ले आफ्नो संस्थाको दुइ वर्षको विवरण नबुझाए पछि कानुनी आधारमा यसको दर्ता खारेजी गरेको बुझिन्छ l दर्ता खारेजी भएको संस्थामा संस्थागत गतिविधिहरु भने सुचारु रुपले चलिरहेका थिए l सन् २००२ को सेप्टेम्वर ९ तारिख पछि पनि संस्थाको नेतृत्व परिवर्तन देखि आर्थिक गतिविधि चली रहनु कानुनी रुपमा सहि थिए भन्ने ठाउँ देखिदैन l यस विचमा रहेको ‘एएनए’ को नेतृत्वलाइ यस विषयमा कुनै जानकारी थियो या थिएन भन्ने बुझन नेपाल मिडिया क्याफेले केहि पूर्व पदाधिकारीहरुसंग सम्पर्क गर्न खोज्दा सम्पर्क हुन् सकेन l

सन् १९८३ मा अमेरिकाको डिसीमा दर्ता भएको ‘एएनए’ को दर्ता खारेजी भएको निक्कै पछि सन् २०११ को मे २५ तारिखमा मेरिल्याण्ड राज्यमा “Association of Nepalis in the America Inc.” (यस संस्थामा America मात्र उल्लेख गरिएको छ Amerikas छैन) नामको संस्था दर्ता भएको देखिन्छ l नेपालीहरुको सामुदायिक संस्था ‘एएनए’ को दर्ता खारेजी भएको झन्डै ९ वर्ष पछि मेरिल्याण्ड राज्यमा पुरानै नामसँग मेल खाने गरि ANA दर्ता कस-कसले र के कारण गर्यो होला ?

दर्ता खारेजी भएको संस्थाको नेत्तृत्वमा रहने वा नरहने भन्ने जानकारीका लागि क्षेवाङ शेर्पा लामासंग नेपाल मिडिया क्याफेले सम्पर्क गर्दा उहाले भन्नु भयो ” मैले ‘एएनए’ को कुनै पदीय रुपबाट बोल्न मिल्दैन जुन कुरा अदालतको निर्देशन हो तर व्यक्तिगत रुपमा मैले मेरा कुरा राख्न पाउछु भन्ने मेरा वकिलको सल्लाह छ त्यसैले मैले व्यक्तिगत रुपमा भन्नु पर्दा जुन संस्थाको प्रगतिका लागि भनेर मरिमेटियो त्यो संस्थाको दर्ता नै उहिल्यै खारेजी भएको छ भन्ने सुन्दा दु:ख लागेको छ l ‘एएनए’ अहिले अदालतमा छ त्यस कारण अहिले केहि निर्णय गर्न सकिदैन जस्तो लाग्छ l अदालतको निर्णय आए पछि के गर्ने भन्ने कुरा अदालतको निर्णयका आधारमा गर्नु पर्ने हुन्छ l ”

एएनएको नेतृत्व आफुले पाउनु पर्ने र वर्तमान निर्वाचनको प्रक्रिया रोकिनु पर्ने आसयकासाथ समुदायका केहि व्यक्तिहरुद्वारा अमेरिकी अदालतमा मुद्दा हालिएको थियो l अदालतले १० दिनका लागि कुनै काम नगर्न र ११ औ दिन अर्थात् अगष्ट १५ तारिख दुवै तर्फका वकिललाई अदालतमा आउन निर्देशन दिएको छ l अदालतले यस विषयलाई नेतृत्व चयनको सामान्य विवादको रुपमा मात्र नहेरेर दर्ता खारेजी भएको संस्थाको संचालन गरेको कसुरका रुपमा हेर्न पुग्यो भने यस विषयसंग सम्बन्धित ब्यक्तीहरुले सत्य तथ्य विवरण बुझाउन लामो समय खर्चिनु पर्ने देखिन्छ l

‘एएनए’ को दर्ता खारेजीले ‘एएनए’ को नाममा रहेको सम्पत्ति के हुने भन्ने जटिल प्रश्न खडा गरेको छ l कानुनी रुपमा संस्था दर्तामा नरहे पछि त्यस संस्थासंग रहेको सम्पत्ति सरकारी हुने हुन्छ l नेपालीहरुले आफ्नो समुदायको केहि बनाउ भन्ने उद्येश्यले चन्दा संकलनबाट आर्जेको सम्पत्ति केहि ब्यक्क्तिहरुको गल्तीले अनाहकमा समुदायले गुमाउने अवस्था आएको देखिन्छ l

Ooh la la ! This is not good. The beginning of the end of the ANA?

Was curious if you knew when the letter from the AG's office was dated? Is it pretty recent or from a couple of years ago? Do you know if any steps have been taken to restore the standing of the corporation since the letter?

If the above news is correct and (1) this is a recent letter from the DC AG's office and (2) no steps have been taken to restore the organizations standing with the authorities, then this places both the organization and many of it's present and past officers in hot soup. I wont be surprised if the ANA finds itself having to wind up on it's own even before the AG's office or the courts get to it as a way to prevent further embarrasment and more lawsuits

As for past presidents, I don't know how much immunity they enjoy when acting in their official capacities and if they can be found criminally liable for anything. This is  a civil suit that's being talked about. Unless of course that guy who got hit in the head by a beer bottle at an ANA party gets hold of a good lawyer and decides to sue for criminal negligence (that's just a fictitious example to prove how vulnerable an organization can be in a situation like this). I won't be surprised if some hefty fines are imposed based on the civil case and the organization loses whatever assets and money it has remaining.

Maybe cooler heads will prevail and things wont come to a complete meltdown?

I heard that the letter was recent. If so, I will join the mass lawsuit movement of voice of ANA.
