 Problem with green card

My current girlfriend married a green card holder and got green card too just 2 years ago. Once she got married she never stayed together with him and her status is still married although she has been filing tax as a single. She is filing her divorce soon. Now I need your help guys, what happen if I marry her? Can I apply for a green card from her? I am currently on student VISA and I am from Nepal. We have been living together for 6 months.

Well if she has a GC now, you should be able to apply after getting a marrige certificate.

first off she needs to oficially change her status to single that should be done by taking care of divorce papers... then i would advice you to get the marriage certificate as soon as possible go to the county office or court and get married. And have the certificate.. Wait till she becomes citizen.This way you would get you greencard within a year and by this way your process would be easier. YOu can apply now but it would take another 5 years for you to green card. And the way the way you talk i feel that you are not going to hang around with her for too long if your intention to be with her was just to get green card then i would suggest move on or wait till she becomes a citizen... Anyway its your life and im not a personal counselor nor an immigrant expert.. its just my thought, you should consult a lawyer.. good luck

Since she married a GC holder instead of Citizen, it will take her another 3 years before she can apply for citizenship. It can take anywhere from a year to more to get the citizenship. I don't think you want to wait that long. Hence, once she finalizes her divorce, apply for the marriage license and get married. Then you can apply for the GC.
