I got my business degree in 2005 but I could get back to school for different reasons. I tried for Canadian visa but was rejected. Recently I came to know that my school has informed INS that I am in Canada. They just knew that I never left US. I went to the lawyer too. He gave me an option. He said unless I get a letter from INS I can apply for H4 through my boyfriend who is applying for H1 coming April. IS THIS TRUE? Is there anyone who have gone through same situation or know anything about it???

I really need help.

yes its better to consult the lawer.  I am also facing similar kind of problem but still i am in status.

Aspire,Sad to know about your case. First of all, you have to make sure that you have a very good lawyer. There are many inexperienced immigration attorneys who may also not charge much, but you have to look for good and experienced ones even though they might charge a bit more. Afterall, it's regarding status, which is very, very important. So, be sure that you have a good immigration attorney before you buy his suggestions. If you're not sure that you're attorney is a good one, I can provide you with the contact info of some good ones. Just let know here in this thread.Next thing, you can apply for H4-dependent of H1B-on April next year. But, you might know as well that you have to first marry him to be eligible to apply for his dependent and thus for the H4 status. The H1B only is valid from October next year, so you might also know that you will not be in status until then. However, applying through your boy friend to be in status is the best option I can see, although I am not an immigration attorney. Last year's H1B visa was based on the lottery system, I am not sure how next year's would be. So, learn about things with the immigration attorney in detail and discuss every scenario. Thank you so much happyface for your concern. There are few things I want to add. We are already planning to get married this year. First of all we will get married here(paper marriage) then in December I will go back to nepal. Once he gets H1 then I can apply for H4 from Nepal. I am depending on this coz he have Master degree and I heard there is more chance to get H1 with Master's Degree  than the undergrad. This is the only option I have thats why I am so eager to know if this option is a good one. I have to make sure before leaving US. I am planning to see different lawyer this week. I live in Colorado springs. Do you know any good lawyer from Colorado??

It looks like you have stayed over 6 months that mean automatic ban for 10 yrs. So don't get married here and

go back. A good lawyer will not advised you this. But i'm not a lawyer, just learned from other people 's situation. good luck..

There are some lawers that i know in boulder; lisa and laura. Ravi is not bad either... if you need numbers to get a hold of them , let me know...
